Duty of Candour

Under legislation from the Scottish Government under the Health (Tobacco, Nicotine, etc. and Care) (Scotland) Act 2016, Health Care providers are bound by law to publish incidents that ‘go wrong’. The Organisational Duty of Candour is a statutory (legal) duty on organisations providing Health and Social care to be open and honest when something ‘goes wrong’, that may not be strictly related to the treatment for the condition for which the person is receiving care.
Responsible persons within Health Care Provider organisations are tasked with devising ways of recording Duty of Candour incidents in a manner that meets their statutory responsibilities. Therefore, as a Health Care Provider, Ayrshire Orthodontics, is required by the Scottish Government to publish an annual report of unintended or unexpected incidents that have occurred during the year as soon as practicable after the end of the financial year. This mush be undertaken even if there are no incidents that need reporting.
